These terms apply when you use Clemant: when you look for a claim, join one, start one or add what happened to you. Clemant is run for Steddle B.V., which is being incorporated in the Netherlands.
What Clemant is
Clemant is where people who were wronged by the same company find each other. You say what happened to you, Clemant records your declaration and checks that your answers are complete, and counts you in the group. When enough people have joined, Clemant can take the claim to a foundation or law firm that may bring it.
Clemant is not a law firm and gives no legal advice. It never weighs up your claim, tells you what to do or promises money, an outcome or a date. Joining creates no client relationship with Steddle. Whether you belong to the group a claim is for is decided in the procedure, not on Clemant.
Free
Using Clemant is free. You never pay Clemant to join a claim, to start one or later. If a foundation or law firm takes a claim on, it tells you its own terms before you say yes to it: in a funded claim a share of what is recovered usually goes to the funder and the lawyers, so the claim itself is not free even though Clemant is.
Joining a claim
When you join, you declare that what the claim describes happened to you too. Answer its questions truthfully and add only documents that are yours to share. You can leave a claim at any time, from your own page.
Starting a claim
A claim names a company, never a person. Write what happened in your own words and leave out names, addresses and account numbers. A person at Clemant reads every claim before anyone else sees it, may tidy the words, and may decide not to publish it; then we tell you why. Once a claim is public, Clemant decides its goal, how it is shown and when it moves on. Once a foundation or law firm takes it on, that party decides what happens in the claim.
What you may not do
- Join or start a claim for something that did not happen to you, or in someone else's name.
- Add another person's details or documents without their permission.
- Use Clemant to harass a person or a company, or to send anything unlawful.
- Try to reach what is not yours, or slow Clemant down for others.
If you do, we may remove what you added and close your account.
Our part
We keep Clemant running as well as we can, but cannot promise it is never unavailable. We may pause or close a claim, for example when no foundation or law firm takes it on or when the facts change; everyone counted stays counted until then, and we tell you.
Liability
To be drafted with counsel.
Which law applies
Dutch law applies to these terms. As a consumer you keep the protection the law of your own country gives you.
Changes
When these terms change, the new version is on this page. When a change affects what you agreed to, we ask you again.
